Impacting AI Boundaries: A Buyer's Guide
With businesses rapidly adopting Artificial Intelligence (AI) to boost performance and competitiveness, it's imperative to consider internal and external controls on their use. Controlling AI can address significant risks like model errors, biased outcomes or uncontrolled data usage, all of which can hinder efficiency and breach regulations.
Internal corporate AI policies play a crucial role. Primarily, these policies need to be extended externally to software suppliers to prevent complications like bias in model design and uncontrolled usage of customer data.
But how can you implement these controls? The process begins by first identifying AI in use. With a surge in interest in generative AI, many suppliers now clearly highlight AI's role within their service offerings. It means defining AI and integrating it into the identification process.
From there, contractual agreements come into play. These may set procurement of consent for new AI solutions, restriction on the way AI is used, or obligations on suitable use.
Which approach customers want to use while imposing control on AI depends on the specific context of the commercial deal. Three broad tactics emerge: a) imposing controls on AI as a general concept, b) directing controls on a supplier's current AI-specific service offerings, c) imposing controls equivalent to current legislative compliance.
Notably, the EU AI Act is now becoming the core for contractual positions. The EU AI Act categorizes AI systems into four tiers based on risk levels. Contracts then align with requirements defined by the relevant risk level.
As various jurisdictions start considering their AI regulations, contracting methods are likely to advance in harmony with the EU AI Act.
Once AI's usage is permitted, the crux is ensuring it functions accurately. Customers considering using AI systems may leverage pilot phases to trial new systems, mitigating risks through progression. Ultimately, effective and ongoing assessment throughout an AI system’s lifecycle is non-negotiable.
