"Theories of punishment
What is the objective of punishment?
It can be explained by the theories of the punishment.
According to research there are various theories of punishment
Following are theories of Punishment, which have evolved over time –
1.Deterrent theory of punishment
Word 'deter' means to prevent
The object of this theory is not only to prevent the wrongdoer from doing a wrong subsequently but also to make him an example for society and other people who have criminal tendencies.
i.e stopping a person from doing crime in future and setting an example for society.
2.Retributive theory of punishment.
Word 'retribute' means payback.
This theory is based on the tit for tat principle.
i.e eye for an eye or tooth for a tooth
According to this punishment should be proportional to the crime committed.
This theory is the most ancient theory of justice.
3.Preventive theory
Main aim of the theory is to prevent the offenders from repeating the offense by giving them punishment.
Preventing offenders from doing crime again.
4.Reformative theory
Aim of the theory is the Reformation of offenders mindset and bringing him/her back to society as a good citizen.
India believes in reformative theory
This theory is based on Gandhian principle: hate the sin not the sinner.
5.Compensatory theory
This theory focus on compensation to the victim for the loss caused by the accused
According to this theory, the object of the punishment is self-realization.
6.Multiple Approach Theory
If a single theory fails to meet the objective, then a combination of theories is the choice to award punishment to offender.
