Reis Robotics USA, Inc. v. Concept Industries, Inc. | 462 F. Supp. 2d 897 (2006)
The Federal Rules of Civil Procedure set forth certain pleading requirements designed to provide an opposing party with notice of the allegations against it. In Reis Robotics USA versus Concept Industries, we explore what happens if a defendant fails to comply with those pleading requirements when filing an answer or asserting affirmative defenses.
Concept Industries, an auto-parts manufacturer, contracted to purchase a laser cutting machine and fixtures from Reis Robotics. During Reis’s production of the equipment, Concept’s specifications changed multiple times, and a dispute arose as to which party would bear the costs of already-performed work. After Concept refused to pay what Reis believed to be the correct outstanding balance for work performed, Reis sued Concept for breach of contract.
Concept filed an answer to Reis’s complaint that included multiple paragraphs with qualifying language surrounding Concept’s admissions or denials. Concept also asserted six affirmative defenses and raised seven counterclaims.
Reis filed a motion in the United States District Court for the Northern District of Illinois to strike various paragraphs in Concept’s answer, strike Concept’s affirmative defenses, and dismiss Concept’s counterclaims.
